1. Assumption of Risk and Waiver of Liability

I understand and acknowledge that:

• Participation in martial arts training, including Boxing, Brazilian Jiu-Jitsu (BJJ), Mixed Martial Arts (MMA), and Muay Thai, involves inherent risks of injury.
• Injuries may include, but are not limited to: bruises, sprains, strains, fractures, cuts, concussions, and other bodily injuries.
• I am voluntarily participating in these activities with full knowledge of the risks involved.
• I assume full responsibility for any injuries or damages that may occur during training.

I hereby release and hold harmless Tru's Fight Syndicate, its owners, instructors, employees, and other participants from any and all liability, claims, demands, or causes of action arising from my participation in training activities, including claims based on negligence, except in cases of gross negligence or willful misconduct.

California Civil Code Section 1542 Waiver

I expressly waive and release any rights I may have under California Civil Code Section 1542, which states:

"A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."

I understand that this means I am releasing unknown future claims that may arise from my participation in training activities.

2. Medical Clearance and Health Acknowledgment

I certify that:

• I am in good physical condition and have no medical conditions that would prevent safe participation in martial arts training.
• I will consult with a physician before beginning training if I have any health concerns.
• I will immediately notify an instructor if I experience any pain, discomfort, or injury during training.
• Tru's Fight Syndicate reserves the right to require medical clearance from a physician before allowing participation if there are any health concerns.

3. Membership and Payment Terms

Pricing

• Monthly membership (one sport): $200 for adults, $175 for kids
• Additional sports: $75 per sport
• Drop-in fee: $25
• Friday open mat is free for all

Membership Terms

• No contracts: Memberships are month-to-month with no long-term commitment required.
• Cancellation: Members may cancel at any time with 30 days written notice.
• Payment: Monthly fees are due on the 1st of each month. Late payments may result in suspension of membership privileges.
• Refunds: Monthly fees are non-refundable once paid. No pro-rated refunds for partial months.
• Freeze: Memberships may be frozen for up to 3 months with advance notice (medical or personal reasons).

4. Code of Conduct

All members and participants must:

• Treat instructors, staff, and other members with respect at all times.
• Follow all safety rules and instructor guidance during training.
• Maintain proper hygiene, including clean training gear and body.
• Arrive on time for classes and notify instructors if unable to attend.
• Use equipment properly and return it to its designated location.
• Refrain from aggressive or inappropriate behavior outside of supervised training.

Violations may result in: Warning, temporary suspension, or permanent termination of membership without refund.

Zero Tolerance Policy

Tru's Fight Syndicate maintains a zero-tolerance policy for:

• Violence or threats outside of supervised training
• Harassment, discrimination, or bullying of any kind
• Drug or alcohol use on premises
• Theft or property damage

5. Minors (Under 18)

• All minors must have a parent or legal guardian sign these terms on their behalf.
• Minors under 13 must be supervised by a parent or guardian while on premises.
• Parents/guardians are responsible for the conduct and safety of their children.

Important Notice for Parents/Guardians (California Law)

California law does not allow parents or guardians to waive their minor child's right to sue for injuries. By signing these terms on behalf of your child, you are acknowledging the risks and agreeing to the terms for yourself, but your child retains all legal rights to bring claims for injuries they sustain. As a parent/guardian, you agree to:

• Ensure your child understands and follows all safety rules
• Supervise your child appropriately based on their age and maturity
• Provide accurate health and medical information about your child
• Indemnify Tru's Fight Syndicate for any claims arising from your own negligence in supervising your child

6. Photo and Video Release

I grant Tru's Fight Syndicate permission to:

• Photograph or video record me during training and events.
• Use such photos and videos for promotional purposes, including social media, website, and marketing materials.
• Members who do not wish to be photographed or recorded must notify management in writing.

7. Privacy and Personal Information

Tru's Fight Syndicate collects and maintains personal information including:

• Contact information (name, email, phone number, address)
• Emergency contact information
• Payment information
• Health and medical information (if provided)

We protect your information by:

• Keeping all personal information confidential and secure
• Never selling or sharing your information with third parties (except payment processors)
• Using your information only for gym operations and communication
• Allowing you to request deletion of your information upon membership termination

8. Facility Use and Property

• Members may only access the facility during posted hours and scheduled classes.
• Tru's Fight Syndicate is not responsible for lost, stolen, or damaged personal property.
• Members are responsible for any damage they cause to facility property or equipment.
• Outside food and drinks are permitted, but members must clean up after themselves.

9. Modifications to Terms

Tru's Fight Syndicate reserves the right to modify these terms at any time. Members will be notified of significant changes via email or posted notice. Continued participation after changes constitutes acceptance of the modified terms.

10. Dispute Resolution

Any disputes arising from membership or participation shall be resolved through:

1. Good faith discussion between the parties
2. Mediation, if necessary
3. Binding arbitration in San Bernardino County, California

These terms are governed by the laws of the State of California.

11. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
